THE UNCONTESTED DIVORCE
Divorce is a divorce, but the term “uncontested divorce” is a type of divorce that occurs when there is little to no fighting between the parties. An “uncontested divorce” typically occurs when the parties can amicably agree on how to split the marital property and assets, and/or how visitation is going to go (i.e. we will follow the standard Texas child custody orders). This is a low cost solution because it doesn’t require the time and money typically required for a contested divorce battle.
It’s important to note that in the State of Texas, there is not an official designation of “contested” vs. “uncontested” divorce, but it is, nevertheless, an important distinction because it helps us provide the best guidance when we meet with potential clients.
There is a couple things to think about and know when you start the process:
- Regardless of how agreeable the parties are, there is generally a 60-day wait period before a Texas Court will grant a divorce petition (unless family violence is involved).
- Every divorce, contested or uncontested, require three things: 1. a petition, 2. some form of service or a waiver of service, and, 3. a final divorce decree.
Being experienced in divorce proceedings, we understand that some things are worth fighting for and some are not (especially if it would be a waste of time and money to try and get something that you have little hope of obtaining), but we also know that there might be things that are not even thinking about as you start the divorce process.
