HOW DOES A PERSONAL INJURY CASE WORK?
PART 1: INJURY
The first part of a personal injury case is assessing the injury. Who was injured? How bad was the injury? Did you or they have to miss work? Was there a Hospital stay? Broken bones? Brain injury? Death or serious bodily injured? Emotional Stress? Long-term disability? All of these are important in assessing the injury.
PART 2: FAULT
The second part is determining fault. Even if you are injured, it is necessary to be able to prove who was at fault for those injuries. Was the other driver at fault? Were they on their phone? Texting? Drunk driving? On Drugs? Speeding? Driving Recklessly? Was there an accident or police report? Was the other driver charged with a crime? Did the driver work for a company or a corporation? What kind of insurance policy did the driver carry? All of these are important questions to ask in a personal injury case.
PART 3: DAMAGES
If you suffered an injury and we can show that the other party is at fault, then we turn to damages. What kind of money damages can we get? Most personal injury cases in Fort Worth, Tarrant County, or Dallas County are disposed of in one of two ways:
1. By settlement agreement, where the parties agree to a specified dollar amount (i.e. typically to compensate for medical bills and injuries sustained in the automobile accident) or
2. By jury trial, where both your personal injury lawyer and the lawyer for the other side present their case to a jury and the jury decides the outcome (i.e. who is at fault? is there any damages? how much are the damages?).
Whether through settlement agreement or jury trial, our clients know that they will have an experienced personal injury attorney on their side that is going to work hard and fight for them each step of the way. We offer personal injury representation throughout Tarrant County (Fort Worth, Arlington, Grapevine, Southlake, Colleyville, North Richland Hills, Hurst, Bedford, Euless, Haltom City, Etc.).
